Nicholas' Expertise

  • Workforce Strategy Working with a wide range of businesses on significant reforms and developments to their workplace relations arrangements. For example Nick worked with a major iron ore mining business with multiple mine, port and rail sites, on a new enterprise agreement strategy. This required the navigation of a complex negotiation process involving multiple union and employee bargaining representatives. The successful outcome was new agreement covering the entire blue collar workforce with significant flexibility and productivity outcomes. He has worked with major companies in other industries such as construction, dredging, healthcare, logistics and others on reforming their approach to workforce engagement including the restructure of workforces, development of new enterprise agreements, engaging labour through multiple sources such as labour hire and contractors, and similar issues.
  • Oil and Gas Advised various major oil and gas operators on industrial relations issues relating to the construction and development of new offshore projects, management of contractor workforces, and issues relating to ongoing operations.
  • Maritime Working with many of the major manning agents in this complex and challenging industry on industrial relations strategy, responses to industrial action, bargaining and right of entry disputes, safety issues and other matters.
  • Safety Advising companies in various sectors including construction, mining, agriculture and other on urgent incident response for serious safety incidents, managing the investigation process, dealing with regulators such as Worksafe, and conducting Coronial Inquiries. He has also worked closely with various boards and senior management groups on reviewing the approach of the business to OHS and ensuring the highest level of compliance is achieved.
  • Government Nick has represented the Australian Building and Construction Commission for many years in various litigation against the CFMEU and others relating to unlawful industrial action, coercion and other breaches of industrial legislation. He has also worked closely with a range of Port Authorities, and major government utilities such as the Water Corporation.
  • Technology Nick works with leading technology companies on managing compliance with labour laws when their rapidly expanding businesses are engaging people in different and innovative ways, that rarely fit “neatly” within the existing legal framework.
  • Healthcare Advising many large hospital and health care providers on various employment and industrial relations issues in this labour intensive and highly regulated industry, ranging from the sale or acquisition of new businesses, to managing the bargaining process for existing workforces.
