Corrs In Brief: Repeal of Part 3A and new regime for state significant infrastructure and development

On 27 June 2011, the Environmental Planning and Assessment Amendment (Part 3A Repeal) Act 2011 (the Act) received assent. When it commences, the Act will repeal the controversial Part 3A of the Environment Planning and Assessment Act 1979 (the original Act) and establish a new regime for development previously falling within Part 3A.
The changes outlined in the Act follow the new Government’s election promise to overhaul the planning system in NSW and return decision-making powers to local communities.
