A commercially-focused senior litigator, Elena specialises in complex construction and commercial disputes, and has significant expertise in arbitration, litigation, expert determinations, Royal Commissions and government inquiries.

She is known for her ability to distil complex legal issues into clearly understandable principles and, in addition to her strong legal skills, is well-practised at leading large multi-disciplinary teams of lawyers, experts and consultants.

Elena has particular expertise in delay and programming disputes, having led these aspects of litigation for clients on matters worth over AU$1 billion.

Elena has completed a Masters of Construction Law at The University of Melbourne, which supplements her extensive construction litigation experience. She has also attended the National University of Singapore’s leadership development programme.

Key deals

Gorgon Project

Acting for a global oil and gas contractor in multiple international arbitrations in respect of claims in excess of AU$1.2 billion arising out of the construction of an LNG loading jetty in Western Australia. One arbitration is under the ICC Rules 2012 and is seated in Singapore and the other is under the UNCITRAL Rules 1976 and is seated in Perth. Leading the delay and programming aspects of the case, including managing experts and dealing with Senior and Junior Counsel from both Australia and Keating Chambers in the UK.

QCLNG Pipeline Pty Ltd - ICC Arbitration

Assisted the principal with claims in excess of AU$1.6 billion, both under contract and statute through an ICC arbitration. Responsible for the delay and various engineering aspects of the case, which included giving advice and drafting of various documents and managing relevant witnesses, experts and counsel.

Victorian Government – Investigations

Assisting Mr Charles Scerri QC with his investigation on behalf of the Department of Health and Human Services regarding the alleged inappropriate conduct of Mr Robert Doyle. Assisted Mr Alex Chernov AC QC with an investigation for the Victorian Government regarding matters arising from the performance of a service provider. Providing ongoing specialist advice and assistance to the Department of Health and Human Services on various matters.

Providing ongoing advice to Cushman & Wakefield across its services portfolio on various disputes and issues as they arise.

Providing ongoing dispute related advice to Mirvac regarding construction related disputes and general commercial disputes.
