Ben Davidson




Ben advises on legal strategy, dispute resolution and managing high risk environments. He has expertise in major infrastructure and construction projects, investigations, prosecutions and Royal Commissions, environmental compliance and regulation, and Public Private Partnerships.

Ben helps his clients to manage risk, negotiations, disputes and inquiries. He operates across all jurisdictions and for a range of industries as well as government.

Ben is Chairman and Board Member at Gather My Crew Limited (not-for-profit).

Key deals


Advising Shell on a range of disputes on the QCLNG Project including BCIPA regime claims and successful Supreme Court litigation to dismiss adjudication (approx. A$80 million), Fast Track Arbitration (A$250 million plus), DRBs with total claim values of A$500 million, and an ICC Arbitration (A$1.6 billion plus).


Acting for Clough on the BassGas (A$400 million claims) on design and commissioning issues related to an offshore platform in Bass Strait, sub-sea and land pipelines and a gas processing plant.

Legal Practice Board/Commissioner

Acting for the Legal Practice Board/Commissioner in various matters, including misappropriation of trust funds (including a A$42 million defalcation) and regulatory proceedings.

Downer Engineering

Acting in an infrastructure dispute arising out of the Tasmanian Gas Pipeline project. Acting on security of payment claims arising out of construction, services and major projects


Acting in retail leasing and construction-related disputes arising out of the Docklands development and on the rectification of the Southern Star Observation Wheel in Victoria, which faced significant engineering issues and related consequences.

Department of Sustainability and Environment

Providing specialist assistance on the Victorian desalination project. Ben drafted ancillary documents for dispute resolution processes, including all associated advice.
