In proceedings commenced by the Australian Competition and Consumer Commission (ACCC), Justice Perram of the Federal Court has found that Optus’ advertising campaign for its “Think Bigger” broadband plans breaches sections 52 and 55A of the Trade Practices Act 1974 (Cth) (the Trade Practices Act).
