Operating in a sector that regularly produces technically and factually challenging disputes, he has particular expertise in contract and “hard dollar” construction disputes.
These skills, in addition to his frontend expertise, assist project proprietors, engineering consultants, contractors and subcontractors in the various construction, engineering, civil, manufacturing and mining sectors disputes they encounter.

Shaun's Expertise
- Walter Construction Group Shaun managed a number of commercial construction and engineering disputes including the Grasstree Mine Development and the Upper Georges River Waste Water Micro-tunnelling Project. Legal issues included bailment, detinue, repudiation of contracts, termination of contracts, recourse to performance security and successfully resisting an application for injunctions, insolvency, administration and liquidation.
- Woolworths $5m payment claims Acted for Woolworths in relation to a contractor’s security of payment claims in excess of $5m. Shaun’s specialist experience enabled Woolworths to respond to a substantial claim within 3 business days in order to meet a strict statutory time limit.
- John Holland $30m disruption claims Wollar to Wellington project expert appraisal process involving delay and disruption claims in excess of $30m.
- UGL Resources rare earth processing plant Advised UGL Resources in respect of contract risk concerning Lynas Corporation’s Rare Earth Processing Plant. The project involved risk assessment of multiple consultancy agreements and an EPCM alliance agreement. Shaun’s advice enabled UGL Resources to close the deal.
- Transfield Shaun is presently acting for Transfield Services in relation to claims exceeding $8m. The claims concern EPCM work and services to Rio Tinto’s reclaimers at Blair Atholl. It is anticipated that the claims will proceed to statutory adjudication followed by commercial arbitration. Shaun also recently advised Transfield Services in respect of termination of its management contract with Telstra.
