Rod is a man of firsts. He is the first lawyer to obtain recognition of an Australian judgment in Japan, arising from a contract dispute involving a large Japanese developer; and the first lawyer in private practice to have acted for the ACCC on the Court record.

Though his dedication is such that he often has the first word, Rod makes sure his clients have the last.

Rod's Expertise

  • $1.2 billion construction contract Advised on breach of contract, extension of time and variation claims, legal professional privilege, repudiation and commercial issues arising from a $1.2 billion contract for the construction of an advanced chemical plant.
  • $40 million action against Japan’s then largest construction company Led an action against one of Japan’s then largest residential construction/developer companies Sanwa Home Inc. The matter was run in Australian and Japan and was the first Australian judgment recognised in Japan.
  • ACCC confirms price fixing The ACCC was successful in its investigation into possible price fixing and market sharing conduct in the clinical waste industry, despite claims of abrogation of legal professional privilege by legislation ultimately being denied by the High Court.
  • Power station construction dispute Acted for the owner of a power station in negotiating a settlement of disputes against the turnkey EPC contractor, with tens on millions of dollars in issue.
  • Protecting our Opera House The ACCC instituted proceedings on an urgent basis after becoming aware of Internet web sites emanating from the United States which fraudulently mirrored Australian Internet web sites operated by the Sydney Opera House. The ACCC obtained judgment against the United States resident alleged to be responsible for the conduct and in doing so, presented complex legal issues including the foreign jurisdictions, the legal basis for obtaining evidence and the enforcement to grant relief.
