  • Asahi Holdings (Australia) Pty Ltd v Pacific Equity Partners Pty Ltd and others Acting for Asahi in Federal Court proceedings claiming losses suffered by Asahi following its acquisition of a business that involved alleged inflated financial information in the due diligence materials. The litigation involves complex allegations concerning the way in which private equity sales are structured and the scope of warranty and indemnity insurance.
  • Strong relationship acting for ACCC over the past decade Acting for the ACCC for over fifteen years in a wide range of enforcement proceedings under Competition and Consumer Act and Australian Consumer Law relating to cartels, price fixing, resale price maintenance, telecommunications and consumer protection.
  • Litigation against Financial Wisdom Limited in Supreme Court of Victoria Acting for 230 plaintiffs in successful funded litigation against Financial Wisdom in the Supreme Court of Victoria. This involved a large number of plaintiffs and documents, and related to losses suffered arising from representations made by proper authority holders concerning tax effective investments.
  • Represented a diverse range of clients on insurance related matters Daniel acts for London underwriters in respect of major claims in Australia. He has also acted for Adecco, AMP General Insurance, Aon, Brambles Insurance Services, Chubb, Downer, P&O Services, GIO, Suncorp, Catholic Church Insurance, Westpac Life Insurance and other corporate clients in a wide range of insurance related matters throughout Australia. Daniel also regularly advises Government and commercial clients on the provisions of their insurance policies and risk.
  • NAB - financial planning matters Acting for NAB in defending a range of financial planning based claims in the Supreme Court of Victoria. These claims have involved complex allegations in relation to the calculation of the alleged loss and damage suffered by investors and the role of financial planners.
  • Dumbrell ats Virginia Surety Inc Acting for a group of defendants defending claims issued by Virginia Surety Co in the Supreme Court of Victoria involving allegations of misleading and deceptive conduct and fraud in relation to the establishment of a new motor vehicle warranty insurance business. The proceeding involved significant forensic discovery issues, strike out applications and insurance issues.
  • 2009 Victorian Bushfires Royal Commission Instructed Counsel assisting the Victorian Bushfires Royal Commission in relation to the insurance issues arising from the 2009 Victorian bushfires. In particular, Daniel and the team were responsible for the conduct of the hearings at the Commission in relation to whether the fire services levy should be abolished, the level of non-insurance and under-insurance in Victoria and whether new insurance initiatives should be introduced to address bushfire risk.
