Patent & Trade Mark Litigation

Patent litigation
Corrs conducts patent litigation and revocation proceedings for applicants and respondents. Our experience in patent litigation spans a wide range of industries and technologies, with extensive expertise in Australian and international jurisdictions, including the co-ordination and conduct of litigation in simultaneous actions in different countries.

Recent important matters in this area include complex patent litigation for Pfizer in relation to the Viagra patents in Australia and New Zealand and patent litigation for Caterpillar against John Deere relating to the undercarriage for tractors. As with our trade mark litigation practice (see below), Corrs patent enforcement practice regularly involves seeking not only permanent injunctions, but also temporary injunctions and search and seizure orders on short notice.

Trade mark litigation
Litigation relating to the protection of clients' trade mark rights forms a large part of Corrs intellectual property practice. We are assisted by a specialised in-house litigation support team, which provides the technology and support services necessary to run complex proceedings. Our understanding of complex technical issues is vital to ensuring that our clients’ cases receive the best possible attention.

Corrs has a very high success rate in stopping infringers, requiring them to place prominent corrective advertisements, and a history of achieving high dollar-value judgements (compared to industry standards). This is achieved through a thorough and tenacious approach (including the use of Anton Piller orders) and an intimate understanding of clients’ businesses.

In a recent high profile Federal Court action, we successfully represented Mobileworld Communications trading as Crazy John's whose trade mark had been infringed by “Crazy Ron's” over a six year period

The list of clients for whom we protect trade marks include some of the world’s most famous companies including Cartier, Caterpillar, Christian Dior, Dunhill, Ferrari, Foster’s Group, Hugo Boss, Lacoste, Louis Vuitton, Maserati, Moët & Chandon, Mont Blanc, Nike, Nokia, Oakley, Quiksilver, Tommy Hilfiger and Veuve Clicquot.
