The acquisition of shares or assets of a company often requires the approval of the ACCC.

Corrs brings the expertise needed to undertake the necessary legal and market analysis and negotiate with the ACCC to achieve successful outcomes - either through the informal clearance process or the formal authorisation route. We can prepare submissions to the ACCC which support or oppose a merger (as the case may be) and we are experienced in litigating contentious merger applications before the court and the Australian Competition Tribunal.

Corrs' recent merger clearance experience includes obtaining the ACCC's consent to the acquisition of the Cashcard business by First Data and successfully opposing the acquisition of Adelaide Brighton Cement by Boral Limited on behalf of an independent, ICL.
