Administrative Law

Corrs advises statutory authorities on governance issues. We deal with the Commonwealth Authorities and Companies Act and legislation establishing statutory authorities and the impact of that legislation on the commercial conduct of those authorities.

We advise departments, agencies and applicants in Freedom of Information matters, including practical guidance to departments dealing with FoI requests, based on our detailed understanding of the Administrative Appeals Tribunal’s likely approach when requests are contentious.

We advise extensively on issues of commercial confidentiality and parliamentary accountability. We have drafted Ministerial Statements for tabling in the Senate supporting decisions refusing to disclose information to the Senate and Senate Committees.

We advise and assist in the making of decisions which will withstand judicial review. We have undertaken major projects assisting ministers to make groups of highly contentious decisions in circumstances where there are very high risks of judicial review action.
