Corrs In Brief: the "publisher's defence" - the High Court supplies its understanding

On 30 April 2009, the High Court of Australia handed down its decision in Australian Competition and Consumer Commission v Channel Seven Brisbane Pty Ltd. The issue for the High Court was whether Seven, which had engaged in misleading and deceptive conduct in breach of section 52 of the Trade Practices Act 1974 (Cth) (Act), could rely on section 65A of the Act, commonly known as the “publisher's defence”.
