Corrs In Brief: Predatory Pricing Prohibtion14 September 2007
The Treasurer has accepted radical changes suggested by Nationals Senator Barnaby Joyce to the Government's proposed amendments to the prohibition on the misuse of market power in section 46 of the Trade Practices Act 1974 (Act).
The changes propose the introduction of a new provision that would prohibit a corporation with a “substantial share of a market” from pricing its products or services below cost for an anticompetitive purpose.
