The Takeovers Panel has received another blow at the hands of the Federal Court. Whether or not it will be fatal will rest in the hands of the High Court, but Corporate Advisory lawyers Andrew Lumsden and Kate Drew argue that the High Court is likely to side with the minority and restore the Takeovers Panel to its position as the premier forum for the determination of takeover disputes in this country.
